General Sales Conditions (GSC)

  1. Scope and Definitions

These General Sales Conditions (GSC) govern all bookings for tours, activities, and experiences (“Services”) made by the Client (the “Client”) through the website https://mysecretmorocco.com (the “Platform”), operated by Caravan Atlas SARL (“Caravan Atlas”, “We”, “Us”).

  • Service Provider: The third-party company or individual who directly provides and delivers the booked Services (e.g., the local guide, the transportation company, the hotel).
  1. Role of Caravan Atlas

2.1 Intermediary Status: Caravan Atlas SARL acts solely as an independent booking agent and intermediary between the Client and the Service Provider. Our responsibility is limited to facilitating the booking process, confirmation, and payment collection as an agent on behalf of the Service Provider or as an agent for the Client, depending on the payment method.

2.2 Contractual Relationship: The contract for the delivery of the specific Service (e.g., the tour, the activity) is concluded directly between the Client and the Service Provider. Caravan Atlas is not a party to the contract for the actual delivery of the Service and, therefore, is not responsible for the Service Provider’s performance, errors, or negligence.

  1. Booking and Confirmation

All bookings are subject to availability and are only confirmed upon Caravan Atlas sending a written confirmation (usually via email) to the Client. The Client is responsible for ensuring all booking details (dates, names, types of Service) are accurate prior to confirmation.

  1. Pricing and Payment

4.1 Pricing: The price of the Services is set by the Service Provider and displayed on the Platform.

4.2 Payment Methods and Responsibilities: Payment for Services may be handled in one of three ways, dictated by the specific Service Provider’s terms:

  1. Direct Payment to Service Provider (On the Day): If the Platform indicates this option, the Client is responsible for making the full payment directly to the Service Provider upon arrival or delivery of the Service. Caravan Atlas is not involved in the transaction and bears no responsibility for the final payment completion or receipt.
  2. Payment via Platform Link or Direct Payment to Caravan Atlas (Card or Bank Transfer):
  • In this instance, the Client makes payment to Caravan Atlas via a secure payment link, credit card, or bank transfer.
  • Caravan Atlas acts as the payment collection agent for the Service Provider.
  • Payment to Caravan Atlas releases the Client from their debt obligation to the Service Provider.
  • All financial data is processed in accordance with our Privacy Notice and secure payment protocols (PCI DSS compliant systems).

4.3 Payment Currency: All prices and payments shall be executed in the currency specified during the booking process.

  1. Cancellation, Amendment, and Refunds

5.1 Supplier’s Terms Prevail: The specific cancellation and amendment terms, conditions, and associated penalties are set by the individual Service Provider and are displayed to the Client during the booking process. These Service Provider terms shall always prevail over any general terms.

5.2 Caravan Atlas Minimum Policy: Notwithstanding Section 5.1, most Services require a minimum cancellation notice of forty-eight (48) hours before the scheduled start time to be eligible for any refund.

5.3 Process: The Client must submit any cancellation or amendment request in writing via the Platform or to the email address provided in Section 2 of the Privacy Notice. The applicable refund amount, if any, will be processed based on the Service Provider’s specific policy. Caravan Atlas is responsible only for administering the refund amount received from the Service Provider.

  1. Limitation of Liability

6.1 Intermediary Liability: Caravan Atlas SARL shall not be liable for any direct, indirect, consequential, or incidental damages or losses arising from:

* The Service Provider’s failure to perform the Service.

* Any injury, loss, accident, delay, or irregularity resulting from the Service Provider’s actions or omissions.

* Any matters related to direct payments made between the Client and the Service Provider.

6.2 Maximum Liability: In any event where Caravan Atlas is found liable, its liability shall be strictly limited to the amount of the commission or service fee received by Caravan Atlas for the specific booking in question.

  1. Force Majeure

Caravan Atlas shall not be liable for any failure or delay in performance of its obligations under these GSC due to acts, events, or omissions beyond its reasonable control, including, but not limited to, natural disasters, war, political instability, travel restrictions, or governmental acts.

  1. Governing Law and Jurisdiction

These GSC are governed by, and shall be construed in accordance with, Moroccan Law. Any dispute arising from the interpretation or execution of these GSC shall be submitted to the exclusive jurisdiction of the competent courts of Casablanca, Morocco.
